1. Ownership

Before proceeding with an order, you will be required to show that you have read and understood the following terms and conditions.

This website is the property of Emporium Kalu Limited, Registered company number 268461. All material on this website is copyright to Emporium Kalu, and is provided solely for your personal, non-commercial use. You may not use this website for any commercial purpose.

 

2. Products

We have made every effort to display as accurately as possible the appearances, colours, textures or finishes of our products that appear on the website. What you see will depend on your monitor and computer equipment; we are therefore unable to guarantee that the product images are an accurate representation of the actual merchandise. All descriptive matter, drawings, pictures, colours, specifications and advertising on the website are for the sole purpose of giving an approximate description of the products.  We reserve the right to withdraw any product from the website without any prior notification. We also reserve the right to amend prices of products without prior notification. Please refer to our Returns Policy below if you are unhappy with your purchase.

 

3. Making a Purchase and Payment

You will be guided through the process of placing an order by a series of instructions on the Website. You place your order for Items from the Website by clicking on the [Purchase] button at the end of the on-line order process. Our products are priced in Euro. When paying by credit card this is the amount which will be deducted from your debit or credit card.  When purchasing products with sterling or other currencies, debit or credit cards, the exchange rates will be set by the cardholders bank.  These rates fluctuate on a daily basis, for further information, cardholder should contact their bank as exchange rates are not applied by Emporium Kalu.  All prices shown on our website are inclusive of VAT. When an order is placed on our website, you will receive a confirmation email confirming we have received your order and it is being processed.  You will receive a second email from us acknowledging your order has been dispatched with a tracking number where applicable.

All products are subject to availability.  Our display of products on our website is an invitation and not an offer to sell those goods to you. An offer is made when you place the order for your products.

If products that you order are out of stock, subject to a delay or the price is higher than that shown on your order, we will try to contact you at the email address you provided when placing your order. If we cannot contact you or receive no response to our email, we will continue to process any remaining products on your order. We will not supply a replacement product without your authorisation.  If you would like to cancel your order please see returns section of our policy.

 

4. Delivery

We ship to the following countries: The whole of the Ireland and UK and all EU Countries. For deliveries outside the EU please telephone our office at the telephone number above for confirmation.
We aim to deliver your chosen items to the place and person of your choice, in perfect condition and in the shortest possible time by using the most appropriate courier for speedy delivery. Delivery services are generally provided by An Post. Standard delivery to most addresses in Ireland generally takes up to 2-3 working days. Express Delivery takes up to 1-2 working days and requires a signature. Please place your order before 12.30pm in order to ensure next day delivery. If An Post is unable to deliver your item, they will leave a delivery notification docket for you. This outlines all the information on how to collect the item(s). You can collect your item(s) from their local delivery units or they can arrange redelivery to the same or alternative address. All items can be tracked using the track & trace option on An Post.

Multiple items may be delivered in more than one parcel and at different times. Deliveries may be delayed due to adverse weather conditions or other events beyond our control.

All deliveries require a signature upon delivery. The signature of the person accepting delivery at the delivery address will be proof that delivery has been received by you or the person, to whom the order is addressed. If no one is available to accept the delivery you will receive a card to advice that a delivery has been attempted. Unfortunately we cannot specify specific delivery times during the day.

All purchases are insured by us while in transit until delivered to you. If you wish to track your parcel, please email us at emporiumkalu@eircom.net and we will either track your shipment for you or email you a tracking number of the courier and their contact details.

 

5. Returns Policy

Customer satisfaction is always our top priority. We handle each query on an individual basis and to the best of our ability. The Returns and Exchange Policy described below applies only to online purchases made through our website.

 

Refunds and Exchanges

We are happy to offer a refund if the item is unsuitable within 7 days of receipt.  The product you return must be in new, unused, and unworn condition with tags attached and in original packaging. It is our policy to return goods to the purchaser if we suspect that any product has been used or worn.  All dispatched orders will include a written confirmation outlining your purchase details, our contact details and return address. Please insert the original confirmation document in the returned parcel, without this we may not be able to track your details.

Following inspection an email shall be sent confirming receipt and you will be refunded the amount due through the original method of payment, excluding original postage charge.

You should expect to see the refund in your account within 5 working days from receipt of this email; however some banks may take longer. If you have not received this money into your account after 10 working days you should contact emporiumkalu@eircom.net.  We are happy to exchange a product for the same product but in a different size, if available pending the product being returned is new, unused and unworn condition with tags attached and in original packaging.  If a different product is requested then a new order must be completed on the website by the user.

6. Gift Cards and Credit Cards

Gift cards

Gift Card purchases will be dispatched within 24 hours.  All Gift Card orders are sent by registered post with An Post.

Please note – Gift Cards cannot be returned once purchased and cannot be exchanged for cash or other gift cards.  Gift cards purchased in-store or on our website cannot be used as a form of payment on the website, they may only be used in-store. We cannot take responsibility for any gift cards that are lost, stolen or used by someone other than your recipient after delivery.  Gift vouchers purchased in-store or on our website cannot be used as a form of payment on the website.

We cannot take responsibility for any gift vouchers that are lost, stolen or used by someone other than your recipient after delivery. Make sure your recipient has received their gift voucher, as it is their responsibility to keep the Gift Card safe.

 

Credit Cards

Emporium Kalu allows orders to be processed online, or over the phone, using a valid credit or debit card, subject to the Paypal payments terms and conditions as provided for above.
Your credit card company may undertake an additional security check to confirm it is you making the order.
All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses, or subsequently refuses to, or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

 

7. Passing of Property and Risk

We will retain the legal ownership of the Items until full payment has been made by you and such payment has been received by us. Legal ownership of the Items will immediately revert to us if we refund any such payment to you.

Risk in the Items will pass to you on at the point the goods you have ordered are despatched from our warehouse to be delivered to the address you have given us.

 

8. Cancelling your order under The Distance Selling Regulations

If you are based in the EU under the Consumer Protection (Distance Selling) Regulations 2000 (DSRs), you have the right to cancel your order with us, provided you give us written notice within 7 working days of receipt. Notice of contract cancellation under the DSRs must be given in writing to: Emporium Kalu, 16 South Main Street, Naas, Co. Kildare, Ireland or by email to: emporiumkalu@eircom.net

For orders cancelled under the DSRs, we will issue you with a full refund. However, you will need to return the entire order to us by secure means to ensure it reaches us in good condition, at your own cost. Cancelled orders should be returned to Emporium Kalu, 16 South Main Street, Naas, Co. Kildare, Ireland

All items must be returned unused and in their original condition, from the original delivery country.

We recommend that you insure the return shipment as you are under a duty to take reasonable care of the goods and will be liable for damage to them until we receive them at our warehouse. In case of dispute, we also recommend you retain proof of sending. Refunds will be issued within 30 days of us receiving your cancellation notice. If we do not receive the cancelled order back, we will arrange to have it collected from you at your cost.

Please note you may only use your right to cancel the order under the DSRs if you give us formal written notice of cancellation within 7 working days of receiving the order, by email or post as described above, i.e. before requesting your RMA

 

9. Copyright and Trade Marks

All content available on the Website, including, but not limited to, text, graphics, logos, button, icons, images, audio clips, data compilations, and software, and the compilation thereof or other material contained in either sponsor advertisements or email-distributed, commercially produced information presented to you on the Website by us, or our advertisers or other content providers (the “Content”) is the property of Emporium Kalu, our affiliates, our partners or our licensors, and is protected by Irish and international copyright laws.

The trade marks, logos, and service marks displayed on the Website (collectively, the “Trade Marks”) are the registered and unregistered marks of Emporium Kalu, our affiliates, our licensors or our partners, in Ireland and other countries, and are protected by Irish and international trade mark laws. All or any other trade marks not owned by us, our affiliates, our partners or our licensors that appear on the Website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us.

 

10. Governing Law

Your use of this Website and any purchase by you of any Item from Emporium Kalu shall be governed by Irish law and you hereto submit to the exclusive jurisdiction of the Irish courts.
